DOC 01 — PRIVACY POLICY

EFFECTIVE 2026-08-15

What we know about you, and what we do with it.

1.1What we collect

Only what you hand us: an email address if you join the mailing list, contact and order details if you request a quote (name, email, organization, garment, colorway, quantity, notes), and whatever's needed to ring up a sale at the register. That's the inventory.

1.2What this website collects on its own

The pages themselves do not run advertising or analytics pixels. Fonts and photos are served from this site. Cloudflare (hosting) keeps standard request logs for security. Termly's consent manager records your cookie choice. If you allow Performance and Functionality, tawk.to can see the pages you are on and a chat session — even before you type a message. Quote and restock forms POST to our Worker and are stored in our database, then emailed to the shop through Resend. We do not sell or share that information for advertising.

1.3What we use it for

Replying to you, filling your order, and — if you joined the list — telling you when a new lot lands. In legal terms: we process your details to take the steps you've asked for (quotes, orders), with your consent (the mailing list), and to meet obligations we can't dodge (tax records). That's the whole list of purposes.

1.4What we never do

We don't sell, rent, trade, or “share” your information for advertising, we don't run trackers, and we don't buy data about you from anyone else. Nobody needs a data broker to sell sweatshirts in Manistique.

1.5Who else touches it

At the register, a PCI-DSS-compliant processor sees card details; we do not store full card numbers. Online, when checkout is switched on, Stripe's hosted page is intended to take the card — not this website. Quote and restock messages are stored with us (Cloudflare D1) and emailed via Resend. Termly runs the consent banner. tawk.to delivers optional live chat after you allow it. Cloudflare hosts the site. These providers act on our instructions. They are based in the United States, so a message from abroad still lands there. For a transfer from the EEA, UK, or Switzerland we rely on the tools those vendors publish: Cloudflare's EU–U.S. Data Privacy Framework certification and Standard Contractual Clauses in its customer DPA; Termly's DPF certification and SCCs; Resend's DPA with SCCs; tawk.to's DPA with SCCs; and, when checkout is live, Stripe's customer DPA (SCCs and, where certified, DPF). We do not claim those frameworks ourselves.

1.6How we protect it

The site runs over HTTPS, we collect as little as possible, and card numbers never touch our systems. The longer story — including what happens if something ever goes wrong — is posted in Trust & Security.

1.7How long we keep it

Order records as long as tax law requires; the mailing list until you unsubscribe; quote requests for one year, then deleted; server logs roll off after about thirty days.

1.8Your rights

See it, fix it, take it, delete it — your call. Email shop@passiveapparel.com or call +1 (906) 978-8381 and we'll send a copy of what we hold, correct it, hand it over in a portable file, or erase it (minus the records tax law makes us keep). We answer within a week — not the thirty or forty-five days the statutes would allow us. You can object to any use of your details, or ask us to pause using them while we sort something out — and every mailing-list email carries a one-click unsubscribe and our mailing address. This site does not collect California “sensitive personal information” (things like a Social Security number, precise geolocation, or health data), so there is no sensitive-PI use to limit; if that ever changes, this page changes first.

1.9California, Europe, and everywhere else

California's privacy law is written for businesses far bigger than this one, and Europe's GDPR for businesses that market to or track people in the EU — we do neither. But the rights read the same either way, so we extend them to everyone: know, correct, delete, take your data with you, and no worse treatment for asking. There's no “Do Not Sell or Share” link here because there's no selling or sharing to opt out of. EU and UK readers can also complain to their local data-protection authority — though we'd rather you call us first.

1.10Kids

The shop and this site are for a general audience. We don't knowingly collect information from anyone under 13 (or under 16 where that's the line), and a kid's email on our list gets deleted the day we learn about it.

1.11Changes & questions

DOC 02 — TERMS OF SALE & SITE USE

EFFECTIVE 2026-08-15

The deal, in ten clauses.

2.1The agreement

Buying from us — at the register, by quote, or wholesale — means these terms apply to that purchase. Using this website means the site clauses (2.7–2.9) apply too. Ordering for a company or a crew? We'll take your word that you're allowed to.

2.2Prices

The price list on the wall and on the pricing page is the price. No coupon games, no fake sales. Prices can change between lots; whatever was posted when you paid is what you pay.

2.3Quotes

A quote request is not an order and a reply is not a contract. Team and wholesale orders are confirmed only when we've both agreed on garments, quantities, artwork, and a date — in writing — and a deposit has cleared.

2.4Payment & pickup

Retail is paid at the register. Team orders take a 50% deposit, balance at pickup. Wholesale ships after payment, or on net-30 once we've done business before. Orders not picked up within 60 days may be restocked after we've tried to reach you twice.

2.5The repair promise

If a seam, cuff, or hem on a garment we made fails in normal wear, we repair it free for the life of the garment. This covers workmanship — not razor blades, campfires, or the dog. Repairs happen at the bench; if you're far away, call and we'll sort shipping.

2.6What we're on the hook for

If we get something wrong, our responsibility is to repair, replace, or refund the garment — that's the ceiling. We're a clothing shop; we don't accept liability beyond the price of the clothes, except where the law says otherwise.

2.7This website

The site is a shop window: browse the collection, read the specs, send a quote. It's provided as-is — we keep it accurate and running as best we can, but a typo in a spec or a lot that sells out before the page updates doesn't create a claim. The copy, the design, and the Passive Apparel name are ours; the photographs are used under license and credited to their photographers. Link to us freely, don't pass our work off as yours.

2.8Fair use of the site

Don't scrape the quote form, hammer the server, probe for holes, or impersonate the shop. Security researchers: look, don't break — and tell us what you find (see Trust & Security, clause 5.6).

2.9The forms

The quote form and the mailing list are for people who actually want garments or news. A submission isn't an order (see 2.3) and doesn't create an account — there are no accounts here, no passwords, nothing for you to maintain or us to lose.

2.10Disputes & changes

Passive Apparel LLC is a Wyoming LLC, formed in Wyoming. The shop at 436 Oak St, Manistique, MI 49854 is the operational and customer-service address, not the state of formation. First step is always a phone call — +1 (906) 978-8381, or shop@passiveapparel.com if you'd rather write (formal notices can follow the mail route in clause 3.5). Nearly everything gets fixed there. Anything that can't be is governed by Michigan law, in the courts covering Schoolcraft County — except that this clause does not waive mandatory consumer, privacy, accessibility, tax, or other protections that cannot lawfully be waived. If these terms change, the new version is posted here with a fresh date; the terms posted when you bought are the ones that apply to that purchase. And if a court ever strikes one clause, the rest still stand.

DOC 03 — RETURNS & REPAIRS

EFFECTIVE 2026-08-14

Wrong size? Loose seam? Here's the process.

3.1Returns

30 days, unworn and unwashed, tags on, receipt or order email in hand — full refund to the original payment. Past 30 days or no receipt, we'll offer store credit if the garment is in sellable shape.

3.2Exchanges

Size and colorway swaps are free anytime within 30 days, subject to floor stock. If your size is out, we'll hold your swap for the next lot — they're numbered, you'll know when it lands.

3.3Repairs

Workmanship repairs are free for the garment's life (see clause 2.5). Wear-and-tear repairs — patches, new ribbing, zipper swaps — are done at cost. No appointment; walk in with it.

3.4Custom & embroidered goods

Garments embroidered or printed to your order can't be returned for a refund — but if we got the work wrong against the approved proof, we remake them free.

3.5By mail

Not local? Email shop@passiveapparel.com for a return authorization before shipping to 436 Oak St, Manistique, MI 49854. We cover return postage when the mistake is ours.
